Case Study
The present centralised web-based system of registration, known as e-Nathikaran was put into practice in Dec 2014 and computerisation of registration started in the state of West Bengal. Although, the deeds registered were only physical, written and executed on pieces of papers. After the introduction of e-Deed facility in December 2019 the entire process of registration was made online and would be completed without visiting office. Here the innovative aspect is the introduction of e-Deed in registration process. At present the deed may be prepared electronically in predefined format as well as electronic execution (Aadhaar based e-Signing) and submission of executed document for registration. This e-deed facility replacesthe manual process of deed preparation.
Problem
The problems was to make an online system for facilitating the citizen/investors for preparation of deed electronically. And in predefined format and completing the registration process in online mode with downloadable facility of registered document from the system without visiting office. It aims to abolish the physical touch points for deed preparation and to get registered sale documents online. There were many issues faced by MSMEs:
- Ease of doing business remains a bottleneck
- Lack of financial expertise
- Lack of access to financing solutions
- Technology remains a major deterrent
- Labour issues, lack of trust
- Absence of collateral in loan
Solution
For the preparation of draft e-Deed using the menu available for the purpose under the link “e-Registration”. Submission of the draft e-Deed so prepared together with map or plan (if any), identification proof like PAN, etc. But without photo-ten fingerprints sheet(s) of the seller(s) & purchaser(s), to the registration authority and wait for approval. Then the approval or disapproval will we provided within 24-hrs after submission, SMS from the authorised system will be provided. In case of disapproval the reason for disapproval will also be notified. The applicant can resubmit in case of disapproval.
Once it was approved, the e-payment can be done and the e-Deed is issued electronically. e-Payment can be made using the link “e-Payment of Stamp duty and Registration fees” available at the homepage of the portal. Then an OTP is sent to the registered mobile. Once the e-Deed is executed and respective e-Payment made, it is ready for submission for registration. Submission is to be done using the menu available for the purpose under the same “e-Registration” link. In the process the e-Payment made is verified first and then accepted as successful submission. This certificate will contain the system generated receipt number. If any additional document is required, the applicant is informed that he/she needs to upload the photo-ten fingerprints sheet(s) of the seller(s) & purchaser(s) before visiting the proper registration office to complete the registration of the e-Deed. Uploading of the photo-ten fingerprints sheet(s) of the seller(s) & purchaser(s) is to be done using the “e-Registration” link.
Outcomes
After the introduction of e-Deed facility in December 2019, the entire process of registration was made online that has benefitted citizens/businesses/industries. There is no need to visit the registration office. Submission of information for property registration is done online, so is the payment of stamp duty and registration fees. The deed is prepared electronically in a pre-defined format that can be downloaded from e-Mail or by logging into the portal. The system is transparent and is easy to use. The timelines have reduced from one month to one day.
The MSMEs in the state have benefitted, as follows:
- Bank loans (collateral free)
- Subsidy on patent registration
- Overdraft interest rate exemption
- Industrial promotion subsidy eligibility
- Protection against payments (delayed payments)
- ISO certification charges reimbursement
